1. Introduction 

Welcome to Fimonaa. These Terms & Conditions (“Terms”) govern your access to and use of our website and services (the “Site”), and the purchase of products from us. By placing an order, you agree to these Terms. 

2. Definitions 

  • “We”, “us”, “our” refers to Fimonaa 

  • “You”, your” refers to the customer, visitor, or user 

  • “Product(s)” means goods listed on our Site 

  • “Order” means the purchase of Product(s) by you through our Site 

3. Eligibility 

You must be at least 18 years old, or otherwise legally capable of entering into binding contracts under Indian law, to purchase from us. 

4. Order Acceptance & Cancellation 

  • Once you place an order, we will send an order confirmation by email. This is not an acceptance of the order. 

  • We reserve the right to refuse or cancel your order at our discretion (e.g., out of stock, pricing error, suspect fraud). 

  • In case of cancellation after payment, we will refund your payment in full (see Refund Policy). 

5. Pricing & Payment 

  • All prices are in Indian Rupees (INR) and include applicable taxes (GST). 

  • Payment must be made in full at the time of placing the order via the available payment methods (credit/debit card, net banking, UPI, wallets, etc.).


6. Product Information & Availability 

  • We strive to display accurate product information (colours, sizes, materials). However, slight variations may occur due to display differences.

  • Stock availability is subject to change; an item shown as available could become unavailable by the time you place an order. 

  • Measurements may vary slightly depending on the fit preference. 

  • The colour of the products in pictures might appear slightly different from the actual product due to lighting and professional photography. 


2. Privacy Policy 

1. Introduction 

Your privacy is important to us. This policy describes how we collect, use, share, and protect your personal data when you use our Site. 

2. Information We Collect 

  • Personal Information: name, email address, mailing address, phone number, payment information 

  • Transactional Data: your orders, purchases, returns 

  • Technical / Usage Data: IP address, browser type, pages visited, device information 

  • Cookies & Tracking: We use cookies, web beacons, and analytics tools to improve user experience. 
     

3. How We Use Your Information 

We use your data to: 

  • Process and manage your orders 

  • Send you order confirmations, updates 

  • Provide customer support 

  • Improve and personalise the Site 

  • Run marketing communications (if you opt in)

  • Comply with legal obligations (tax, audits, fraud checks) 

4. Sharing / Disclosure 

We may share your information with: 

  • Payment gateways/banks (for processing payments)

  • Shipping/courier partners (for delivery) 

  • Service providers who assist in marketing, analytics, and email services 

  • Law enforcement or regulators, when required by law 

We will not sell your personal data to third parties.

We retain your personal data as long as necessary for the purposes listed above, or as required by law (e.g. tax records retention).

We adopt reasonable security measures (SSL encryption, restricted access, secure servers) to protect your data, though no method is completely foolproof. 

7. Your Rights 

Depending on applicable law, you may have rights to: 

  • Access, correct, or delete your personal data 

  • Opt out of marketing communications 

  • Withdraw consent (where relevant) 

  • Lodge complaints with a supervisory authority 

8. Children’s Privacy 

Our services are not meant for children under 18. We do not knowingly collect data from minors. 

9. Updates to Privacy Policy 

We may update this policy from time to time. The revised version will be posted on the Site with a new “Effective Date”. 


3. Shipping / Delivery Policy 

1. Delivery Area 

We currently deliver across India, with a few pincode‑level exceptions. You’ll see whether delivery is available to your address on the checkout page once you enter your complete address and pin code.

2. Order Processing Time 

Orders are typically processed within 1–3 business days (excluding Sundays and public holidays) after payment confirmation. 

3. Shipping Timeframes 

  • Metro / urban areas: 2–5 business days 

  • Rural/remote locations: 4–8 business days 
    These are estimates and may vary depending on courier, distance, weather, or other circumstances beyond our control. 

4. Shipping Charges 

  • We may offer free shipping above a certain order value.

  • For orders below the threshold, a fixed shipping fee (e.g. ₹50–₹150 depending on location) will be applied 

  • COD may not apply to all the PIN codes. Orders with COD may incur an additional COD fee (if applicable) 

  • Fimonaa reserves the right to disable COD for customers who repeatedly refuse deliveries.

  • Repeated COD refusals may result in account restrictions or order cancellations.

 

5. Tracking & Status 

Once shipped, we’ll send you a tracking number. You can track your order via the courier’s website or our portal. 

6. Failed Deliveries / Returns to Sender 

  • If delivery fails due towrong address, non-availability, or refusal, the order may be returned to us. 

  • In that event, you can choose re-shipment (you may need to pay shipping costs again) or a refund (minus shipping costs). 

7. Delays 

We are not liable for delays caused by natural disasters, strikes, public holidays, or force majeure events. 


4. Return, Refund & Exchange Policy 

1. Return / Exchange Eligibility 

  • You may request a return/exchange within 14 days (or your chosen window, e.g. 10 / 15 days) from the date of delivery. 

  • The product must be unused, in its original condition, with tags intact and in the original packaging. Items must be free from makeup stains, marks, fragrance, or any signs of wear. 
     

2. How to Initiate Return / Exchange 

  • Contact our support team via email or through the "Live Chat" on the site, providing order number, product details, and reason for return.

  • We will review the request and send you a return shipping label or instruct the courier (or let you send via your own courier). 
     

3. Return Shipping Costs 

  • For defective, damaged, or incorrect items, the return shipping cost will be borne by us. Please contact us as soon as possible upon receiving such items so we can assist you promptly.  

  • For buyer’s remorse (change of mind): you may need to bear the return shipping cost. 

  • Exchanges may require you to pay additional shipping for sending the new item. 
     

4. Refund Process & Timeline 

  • Once we receive and inspect the returned item, we will notify you of approval or rejection. 

  • If approved, the refund will be initiated via the original payment method (credit card, UPI, etc.).

  • Refund processing time: up to 7–14 business days, depending on your bank or payment provider. 
     

5. Partial Refunds / Rejections 
 
If the item is not in original condition, or missing parts, or used, we may reject the return or issue only a partial refund. 


5. Size, Fit & Product Quality 

  1. Size information and responsibility 

    1.1. We provide size charts for each product to help you choose the correct size. Especially for one-size products, size guides with specific measurement details are provided, and for products with multiple sizes (such as XS, S, M, L or EU sizes like 34/36, 38/40, etc.), a separate size guide is available to help you select the most appropriate size.

    1.2. By placing an order, you acknowledge that it is your responsibility to review the size chart, the relevant size guide, and the product description carefully before purchasing.

    1.3. Minor fit variations may occur between different styles and fabrics; such reasonable variations shall not be treated as a defect. Measurements may also vary slightly depending on individual fit preference and how you like your garments to sit on the body.

  1. Colour, print and appearance 
     
    2.1. We make reasonable efforts to display product colours and prints accurately; however, actual colours may vary slightly due to studio lighting, photography, and screen/display settings. 
     
    2.2. Minor colour or shade variation between the product images and the delivered product shall not be considered a defect or grounds for a quality claim. 
     
    2.3. Placement of prints, embroidery, motifs, and embellishments may differ slightly from the images shown due to the nature of fabric cutting and handwork. 

  1. Fabric, embroidery and handwork 
     
    3.1. Many of our products involve delicate fabrics, hand embroidery, beadwork, sequins, zari, or other embellishments. Slight irregularities in weave, embroidery, or hand finish are common characteristics of such products and shall be deemed part of their unique craftsmanship, not manufacturing defects. 
     
    3.2. Normal wear and tear, including minor thread pulls, loss of a few sequins/stones, or fabric pilling over time, does not qualify for a refund or replacement. 

  1. Care instructions and product longevity 
     
    4.1. Care instructions are provided on each product page and/or on the garment label (for example: dry clean only, hand‑wash separately, gentle machine wash, do not bleach, low‑heat iron). 
     
    4.2. You agree to follow the recommended care instructions. We shall not be liable for damage, shrinkage, colour bleeding, or loss of embellishments resulting from improper washing, drying, ironing, storage, or use of harsh chemicals. 
     
    4.3. Perfume, deodorant, and sweat may affect delicate fabrics and colours over time; such effects will not be treated as product defects. 

  1. Quality checks and defects 
     
    5.1. All products are inspected before dispatch; however, in the unlikely event that you receive a product with a genuine manufacturing defect or transit damage, you must notify us within [48 hours] of delivery with clear photos and order details. 
     
    5.2. We reserve the right to assess the reported issue. Only defects confirmed by our quality team as manufacturing or transit-related will be eligible for repair, replacement, or refund in accordance with our Returns & Refunds Policy. 
     
    5.3. Items returned without tags, with signs of wear, stains, perfume/smoke odour, alterations, or damage caused by the customer may be rejected and sent back at your cost. 

  1. Hygiene‑sensitive and non‑returnable items 
     
    6.1. For hygiene reasons, certain categories such as innerwear, padded garments, shapewear, hosiery, and customised or altered products may be marked as “non‑returnable” or “final sale” on the product page. 
     
    6.2. By purchasing such items, you acknowledge and agree that they are not eligible for return, exchange, or refund except in case of a confirmed manufacturing defect. 

  1. Limitation of liability for size & fit 
     
    7.1. If a product does not fit as expected and there is no confirmed defect, the order will be handled under our standard return or size‑exchange policy (where offered), and not as a quality claim. 
     
    7.2. Our maximum liability for any size, fit, or quality‑related claim shall be limited to the amount paid for the product in question, subject to the terms of our Returns & Refunds Policy. 

  2. All disputes are subject to jurisdiction of courts in India. Fimonaa holds the right to update policies without prior notice.
